China Incorporation FAQ

Do I need to be present in China during the WFOE registration process?
If you are setting up the company as a private investor, your effective presence would be required at times since your passport would be required. If you are setting up the WFOE with an overseas/offshore company as its parent company, then your presence will not be required

How long does it take to register a WFOE?
It takes on average 6 weeks to obtain the business license, and two to three months to complete the whole procedure.Based on your specific industry and type of company, however, it might take longer (especially for manufacturing companies).

Hong Kong Incorporation FAQ

Do I need to go to Hong Kong to form my Hong Kong company?
No you do not need to travel to Hong Kong in the incorporation process. All the forms are signed and transfered through our office, and once the company is formed, the relevant documents will be sent to you or can be picked up at our office as well.

Does the Hong Kong company help me to get a Chinese visa?
No. A Hong Kong company is considered as a foreign company, and does not provide any benefit whatsoever in terms of residency in mainland China

Can I rent an office in China for my Hong Kong company?
No. The proper procedure would be first to register a representative office for the Hong Kong company. The Hong Kong company by itself cannot rent or purchase an office directly in China.

Can another company be used as shareholder/director of a Hong Kong company?
Yes. Corporate shareholders and directors are allowed for Hong Kong companies.

Offshore Incorporation FAQ

What offshore jurisdiction do you recommend for trading/consulting/asset holding?
For trading (especially with China) we believe that Hong Kong companies are the best option available. For consulting and asset holding purposes we recommend the British Virgin Islands and Seychelles

Can I open a bank account in China for my offshore company?
No. To open a corporate bank account in China you will need to be registered in the country. Some Chinese banks now offer offshore bank accounts, however they cannot take deposits/payments from China residents and therefore are no differentor better than banks in other offshore jurisdictions
